1. Introduction

These Terms and Conditions apply to the purchase of artworks, prints, commissioned works, and all transactions made through Lal Rai Fine Art’s online and on-site platforms.

By purchasing artwork, requesting commissions, attending exhibitions, or using our website or other platforms, you agree to be bound by these Terms and Conditions.

If you do not agree with these Terms, you must not use our services or purchase our artwork.

7. Commissioned Artwork

  • Minor revisions may be permitted depending on the agreement.

  • Deposits are non-refundable once work has commenced.

Lal Rai Fine Art retains creative discretion over the final artwork unless otherwise agreed in writing.

8. Ownership and Title

Legal ownership of the physical artwork transfers to the customer only after full payment has been received.

9. Shipping and Delivery

Online and In-Person Purchases

This policy applies to all purchases made through Lal Rai Fine Art, including online orders and purchases at exhibitions, galleries, or the studio.

  • Orders are shipped via reputable carriers such as Australia Post or trusted courier services.

  • Shipping costs are calculated at checkout unless otherwise stated.

  • Delivery times are estimates and may vary depending on location, carrier, and customs procedures.

  • Orders are typically dispatched within 5–10 business days within Australia unless otherwise stated.

  • Risk of loss or damage passes to the customer upon dispatch unless shipping insurance has been arranged.

  • Customers must provide accurate delivery details.

International Shipping

International shipping may be available. Customers are responsible for:

  • Customs duties

  • Import taxes

  • Any additional fees

Lal Rai Fine Art is not responsible for delays caused by customs or international shipping processes.

Customers should inspect artwork upon delivery and report any damage promptly.

All artworks are carefully packaged to ensure safe delivery.

10. Returns and Refunds

Returns and refunds are handled in accordance with Australian Consumer Law.

Customers may be entitled to a remedy if the artwork:

  • Is significantly different from its description

  • Has major damage or defects not disclosed prior to sale

If an artwork arrives damaged or faulty:

  • Customers must notify us within 48 hours of delivery

  • Photographic evidence must be provided

Where applicable:

  • Lal Rai Fine Art will arrange a repair at no cost within a reasonable timeframe.

  • Customers may choose a replacement or refund where permitted by law if the fault significantly affects the artwork’s value, use, or safety.

Nothing in these terms excludes your statutory rights.

Due to the unique nature of original artwork, change-of-mind returns may not be accepted unless approved at our discretion.

Commissioned artwork is generally non-refundable once completed.

11. Cancellation of Commissioned Artwork

  • If a client cancels after work has commenced, the deposit is non-refundable.

  • If significant work has been completed, the artist may invoice for work undertaken.

  • If the artist cancels the commission, all payments (including deposits) will be refunded in full.

  • All deposit and payment terms will be clearly communicated before work begins.

Charges will reflect the work completed and resources used.

12. Intellectual Property and Copyright

All artwork created by Lal Rai Fine Art remains the intellectual property and copyright of the artist unless otherwise agreed in writing.

Copyright is protected under the Copyright Act 1968 (Australia).

Purchasing artwork does not transfer copyright ownership.

Customers may not:

  • Reproduce the artwork

  • Sell copies

  • Use images of the artwork for commercial purposes

The artist retains the right to use images of the artwork for promotional purposes unless otherwise agreed in writing.

13. Use of Artwork Images

Lal Rai Fine Art may photograph or reproduce images of sold or commissioned artwork for:

  • Portfolio use

  • Marketing

  • Website and social media

  • Exhibition catalogues

Clients may request confidentiality for commissioned works prior to completion.

14. Limitation of Liability

Lal Rai Fine Art is not responsible for:

  • Indirect or unexpected losses

  • Damage to artworks occurring after delivery due to improper handling, storage, or display

Nothing in these terms limits rights provided under Australian Consumer Law.

15. Privacy

Personal information collected during transactions will be handled in accordance with the Privacy Act 1988 (Australia).

Information may be used for:

  • Processing orders

  • Customer communication

  • Marketing communications where consent is provided

Personal information will not be shared with third parties except where necessary to complete a transaction.

16. Exhibitions and Events
