Commission Policy – Lal Rai Fine Art

1. Definitions

  • Artist: Lal Rai Fine Art
  • Customer: The person or entity placing the order
  • Artwork: The commissioned or ordered artwork described in the agreement
  • Agreement: These Terms & Conditions together with any quotation, invoice, or order confirmation

2. Quotes & Orders

  • All quotations are valid for 30 days, unless otherwise stated in writing
  • An order is confirmed only upon:
    • Written acceptance of the quotation, and
    • Receipt of the required deposit
  • The Artist reserves the right to decline any commission at their discretion

3. Pricing & GST (GST-Free)

  • All prices are listed in Australian Dollars (AUD)
  • Lal Rai Fine Art is not registered for GST, therefore prices are GST-free
  • Additional costs (e.g., delivery, framing, installation, or special materials) are charged separately unless explicitly included

4. Deposit & Payment

  • A non-refundable deposit of 30–50% is required to commence work
  • The remaining balance must be paid before delivery or collection
  • Payment methods may include:
    • Bank transfer
    • Credit/debit card
    • PayPal
    • Other secure checkout methods
  • The Artist may charge interest or recovery costs on overdue payments in accordance with Australian law
  • Full payment may be required upfront unless otherwise agreed in writing

5. Timeframes

  • Estimated completion: 4–6 weeks after payment (depending on workload and complexity)
  • Timeframes are indicative only and may vary due to:
    • Drying times
    • Material availability
    • Unforeseen circumstances
  • Customers will be notified of any significant delays

6. Changes & Revisions

  • Minor adjustments may be made if agreed in writing
  • Substantial changes to the original brief may incur additional charges
  • Once completed, alterations are at the Artist’s discretion

7. Cancellation Policy

  • If the Customer cancels after work has commenced:
    • The deposit is non-refundable
    • Additional charges may apply for work already completed
  • If the Artist cancels the commission:
    • A full refund, including deposit, will be issued

Note: Under Australian Consumer Law, non-refundable deposits are enforceable if clearly disclosed and services are not misrepresented.


8. Delivery & Risk

  • Shipping and insurance costs are the customer’s responsibility unless agreed otherwise
  • Risk transfers to the customer upon:
    • Collection, or
    • Dispatch of the artwork
  • The Artist is not liable for damage during third-party transport unless separately insured

9. Title & Ownership

  • Legal title remains with the Artist until full payment is received
  • Ownership of the physical artwork transfers to the Customer upon full payment

10. Copyright & Intellectual Property

  • Copyright remains with the Artist under the Copyright Act 1968 (Cth)
  • Customers may not:

    • Reproduce
    • Distribute
    • Commercially exploit the artwork

    without written permission

  • The Artist retains the right to:
    • Photograph the artwork
    • Use it for portfolio, exhibitions, website, social media, and marketing

11. Consumer Guarantees

  • Customers in Australia are protected under Australian Consumer Law (ACL)
  • Services must be:
    • Provided with due care and skill
    • Fit for purpose
    • Delivered as described
  • Nothing in this policy limits your legal rights under ACL

12. Care & Maintenance

  • Customers are responsible for proper care after delivery
  • The Artist is not responsible for damage caused by:
    • Improper handling
    • Environmental conditions
    • Third-party framing
