1. Ownership of Copyright

  • Unless otherwise agreed in writing, all copyright and intellectual property rights in artwork created by Lal Rai Fine Art remain the property of Lal Rai Fine Art and the artist.
  • When you purchase artwork, you are purchasing the physical artwork or digital file only. Copyright ownership is not transferred.
  • Under Australian law, copyright in artistic works arises automatically upon creation.

2. Personal Use Licence

Upon purchase, customers are granted a non-exclusive, non-transferable licence for personal, non-commercial use only.

Permitted uses include:

  • Displaying the artwork in your home or private space

  • Posting on personal social media accounts (credit to Lal Rai Fine Art is appreciated where possible)

This licence does not allow commercial use.

3. Restrictions on Use

Unless prior written permission is provided, customers must not:

  • Reproduce artwork for commercial purposes
  • Sell, license, or distribute copies
  • Use artwork for branding, marketing, advertising, or merchandise
  • Modify, alter, or create derivative works for commercial purposes
  • Claim authorship or ownership of the artwork

Unauthorised use may constitute copyright infringement under Australian law.

4. Moral Rights of the Artist

Under the Copyright Act 1968, artists retain moral rights, including:

  • The right to be attributed as the creator
  • The right not to have authorship falsely attributed
  • The right to object to derogatory treatment of the artwork

Customers must not use or alter artwork in a way that harms the artist’s reputation or integrity.

5. Artist Portfolio & Promotional Rights

Lal Rai Fine Art reserves the right to display and promote completed artwork for:

  • Portfolio display
  • Website galleries
  • Social media promotion
  • Marketing and advertising

If you prefer your artwork not to be publicly displayed, please notify us at the time of order or afterward. We will make reasonable efforts to respect your request.

6. Customer Responsibility for Reference Photos

When providing reference images for custom artwork, customers confirm that:

  • They have the legal right or permission to use the images
  • The images do not infringe any copyright, privacy, or third-party rights

Lal Rai Fine Art is not responsible for infringement arising from customer-supplied images.

7. Commercial Licensing

Artwork may not be used for commercial purposes without prior written permission.

Commercial use includes:

  • Business branding or logos
  • Advertising or promotional materials
  • Merchandise or product sales
  • Publishing or commercial distribution

Customers seeking commercial use must obtain a separate commercial licence agreement, and additional fees may apply depending on usage.

8. Copyright Infringement Claims

If you believe content published by Lal Rai Fine Art infringes your copyright, please provide:

  • Your name and contact details
  • Identification of the copyrighted work
  • Description of the alleged infringement
  • Evidence of ownership or authority

9. Artificial Intelligence & Machine Learning Restrictions

All artwork created by Lal Rai Fine Art is protected by copyright and must not be used for AI or machine learning purposes without written permission.

This includes:

  • Inclusion in datasets
  • Use in generative/image-generation systems
  • Automated data extraction
  • Replication of artistic style

This restriction applies to all formats, including digital images, prints, and online content. Unauthorised use may constitute copyright infringement.

10. Policy Updates

  • This policy may be updated periodically

  • Continued use of services may constitute acceptance of revised terms
